These Terms of Service (“Terms,” “Agreement”) are a legal agreement between you (“you,” “your,” “User”) and DRL Investments LLC dba Kearney Junk Removal (“Kearney Junk Removal,” “Company,” “we,” “us,” or “our”), governing your access to and use of our website, services, and related content (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

1. Participation Terms

We strive to maintain a positive and professional environment in all programs or services we provide. We reserve the right to suspend or terminate your access to any of our programs, including live, recorded, digital, or social media-based offerings, without refund if you:

• Fail to make timely payments;

• Act in a disruptive, disrespectful, or uncooperative manner;

• Do not follow guidelines or policies set by the Company; or

• Infringe on the experience, rights, or safety of other clients, participants, or staff.

2. Accuracy of Information

We make every effort to ensure accurate information on our website. However, errors may occasionally occur. We reserve the right to correct any inaccuracies—including descriptions, pricing, promotions, or availability—without prior notice, even after an order is placed. We are under no obligation to update information unless required by law.

3. Links to Third-Party Websites

Our website may contain links to third-party websites. These are provided for convenience only. We do not endorse, guarantee, or assume responsibility for the content, services, or practices of any third-party websites. Use of such sites is at your own risk.

4. Confidentiality

If you participate in any Company program or service involving group or private sessions, you agree to:

• Respect the confidentiality of other participants and Company materials;

• Not reproduce, share, or use any proprietary information without written consent;

• Acknowledge that all materials and discussions are the intellectual property of Kearney Junk Removal and its affiliates.

Violation of these provisions may result in immediate termination and legal action.

5. Non-Solicitation Agreement

You agree not to solicit or contact any clients, employees, contractors, or partners of Kearney Junk Removal for personal gain or to compete with our services during your engagement with us and for two (2) years after your relationship with the Company ends, unless you have our written permission. This includes but is not limited to:

• Offering similar junk removal or demolition services;

• Recruiting or encouraging employees or clients to leave the Company;

• Direct selling or promotion unrelated to an approved partnership or collaboration.

6. Reviews, Testimonials, Photos & Videos

By engaging with our Services, you consent to the possible use of your name, image, voice, likeness, testimonials, or submitted content for promotional purposes, including:

• Advertising, marketing, social media, training, and educational use

• Distribution across all media platforms (digital, print, video, etc.)

You waive any rights to compensation, review, or approval of such uses. As a courtesy, we will always ask for your permission before using any testimonials or photos publicly.

7. Limitation of Liability

To the fullest extent permitted by law, Kearney Junk Removal is not liable for indirect, incidental, special, or consequential damages—including but not limited to loss of income, data, business, or goodwill.
Our total liability, if any, shall be limited to the amount you paid us within the one (1) month preceding the event giving rise to the claim. Some jurisdictions do not allow limitation of liability, so this may not apply to you in full.

8. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed, and the remaining provisions will remain in effect.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Nebraska.
Any disputes arising from or related to this Agreement shall be resolved exclusively in the state or federal courts located in Buffalo County, Nebraska.
At our discretion, we may require disputes to be resolved through binding arbitration in accordance with the American Arbitration Association rules.

10. Assignment

You may not transfer or assign your rights or obligations under this Agreement without our written consent. We reserve the right to assign our rights and obligations at any time.

11. Electronic Communication & Signature

By using our website or communicating with us via electronic methods (email, text, forms), you consent to receiving communications electronically. You agree that these communications satisfy any legal requirements that such communications be in writing.

12. Modifications

We reserve the right to modify these Terms at any time. Updates will be posted on this page with a new effective date. Continued use of our Services constitutes your acceptance of any changes.
